REGA Evidence File for Off-Plan Project Licensing

A licensing-focused reference for developers submitting an off-plan real estate project to Saudi Arabia’s Real Estate General Authority. It isolates the official feasibility-study inputs, project records, escrow evidence and portal data required for the project-license request; it is not an investment appraisal.

Officially Evidenced Questions on REGA Off-Plan Licensing

Does the project-licence file legally include a feasibility study?

Yes. Article 6(1)(k) of the Law names an economic feasibility study as an attachment to the project-licence request, and Article 11(1) of the Implementing Regulations makes submission of a project feasibility study a condition for an off-plan project licence. S1 S3

Has REGA published a compulsory feasibility-study template for this request?

The Law requires the economic feasibility study to be prepared by a consulting office. No sufficient official Saudi source was identified to establish a compulsory standard template for that study in the cited project-licence materials. S1, Article 6(1)(k)

Which feasibility inputs are expressly added by the Implementing Regulations?

The Regulations add estimated financial, construction and marketing data, anticipated administrative and financial expenses, a unit-delivery schedule and expected funding sources, in addition to the Law’s Article 6(1)(k) baseline. S3, Article 11(1)

Must the application contain NPV or IRR calculations?

No sufficient official Saudi source was identified to establish NPV or IRR as mandatory fields in the Law, the cited Implementing Regulations or the published project-licence service page. The portal does request financial results and indicators, but does not name those two metrics. S6, steps 19–24

Is developer registration only an optional profile step?

No. The Law links off-plan activity to the Developers’ Register and provides that the developer applies for the project-specific licence after being entered in that register. S1, Articles 3 and 6

Which forecast data does the online request ask applicants to enter?

The published sequence asks for expected project income, an expected annual balance sheet, annual cash-flow information, financial results and indicators, and expected funding sources. S6, steps 20–24

Can the developer use the project escrow account before the licence is issued?

The application includes an escrow-account opening agreement, but Article 9 says the separate escrow account is activated only after the project licence is obtained and the property-registration deed receives the required annotation. S1, Articles 6(1)(n) and 9

What official confirmation can address the building-permit and plan evidence?

Article 11(2) recognises a confirmation letter from Etmam or another authority concerned with building permits, confirming compliance with the regulatory requirements for permits, engineering layouts and architectural designs. The provision states that this letter suffices for the corresponding Law requirements. S3, Article 11(2)

Is a subdivision document relevant to every project?

It is expressly required where the project contains subdivided real estate units. In that case, Article 11(3) calls for an approved subdivision report under the Law of Ownership, Subdivision and Management of Real Estate Units. S3, Article 11(3)

When does the 30-day decision rule start to run?

The Law measures the period from completion of the required documents. It says the competent authority decides within 30 days; if no decision is made during that period, the application is deemed approved, while a rejection must be reasoned. S1, Article 6(2)

What applies if reservation amounts are taken under a marketing licence?

During the marketing-licence period, a developer seeking reservation amounts must disclose the project status and future plans, cap reservations at 5% of the unit value, and deposit all amounts into the designated escrow account. S3, Article 10

Is the feasibility study relevant after the project licence is granted?

Yes. Article 14 requires implementation in accordance with the specifications agreed in the contracts and the feasibility study. It also requires amounts collected from buyers or tenants to be deposited into the escrow account. S3, Article 14

Do the Regulations place project limits on a natural-person developer?

Yes. Article 12 sets three published limits: up to 5,000 square metres of built-up area, a completion period of no more than three years, and no more than three real estate projects implemented each year. [S3

Which information does REGA make publicly available for licensed off-plan projects?

The Regulations provide for a public database. Published items include the project name, deed and approved-plan details, location, area, number and types of units, specifications and implementation data, progress reports, developer name and rating, key project parties, and the project period with start and delivery dates. S3, Articles 23–24

Does the REGA service page publish a fixed fee or fixed service duration for the project-licence request?

The service page states that duration and cost depend on the type of service. No sufficient official Saudi source was identified in the cited materials to establish a fixed fee or one universal service duration for this request. This does not alter the Law’s 30-day rule after the required documents are complete. S6 S1, Article 6(2)
